Please read these Terms of Service ('Terms', 'Terms of Service') carefully before using the Slopestory mobile application and website (together, the 'Service') operated by Slopestory ('us', 'we', or 'our').
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
1. DESCRIPTION OF SERVICE
Slopestory is a mobile application and web service that allows skiers and snowboarders to:
- Track the ski and snowboard resorts they have visited
- Upload and organise photos from their trips
- Add notes, ratings, and dates to their visits
- Discover new resorts and view resort information
- Create and order printed photo books of their skiing and snowboarding memories
- Subscribe to Slopestory Pass for premium features including additional storage and AI-powered tools
- Access AI-powered features for resort discovery and trip summaries
2. USER ACCOUNTS
2.1 Registration. To use certain features of the Service, you must register for an account. You may register using your email address, Google account, or Apple account. You must provide accurate, current, and complete information during the registration process.
2.2 Age Requirement. You must be at least 18 years of age to create an account and use the Service. Persons under the age of 18 are not permitted to use or register for the Service.
2.3 Account Security. You are responsible for safeguarding the password or authentication method you use to access the Service and for any activities or actions under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
2.4 Account Deletion. You may delete your account at any time through the app's profile settings. Upon deletion, we will remove your personal data, photos, and account information in accordance with our Privacy Policy. If you have an active Slopestory Pass subscription, account deletion does not automatically cancel Apple billing — you must cancel your subscription through your Apple ID settings or the App Store. Certain data may be retained as required by law.
3. USER CONTENT
3.1 Your Content. The Service allows you to upload, submit, store, and share content including photographs, text, notes, ratings, and other materials ('User Content'). You retain all ownership rights in your User Content.
3.2 Licence Grant. By uploading User Content to the Service, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, display, reproduce, and process your User Content solely for the purpose of operating and providing the Service to you. This includes:
- Storing and displaying your photos and visit data in the app
- Processing your photos for display optimisation (resizing, compression, placeholder generation)
- Preserving original-quality photos for photo book printing
- Using your content to generate AI-powered summaries and recommendations for you
3.3 Community Photos. If you submit photos to a resort's community gallery, you grant us an additional licence to display those photos to other users of the Service on the relevant resort page. You may request removal of community gallery submissions at any time.
3.4 Content Restrictions. You agree not to upload User Content that:
- You do not have the right to share
- Is illegal, harmful, threatening, abusive, or defamatory
- Infringes any patent, trademark, trade secret, copyright, or other proprietary rights
- Contains software viruses or malicious code
- Is sexually explicit or contains nudity
3.5 Content Moderation and Enforcement. There is zero tolerance for objectionable content or abusive users. Any user found posting objectionable content or engaging in abusive behaviour will have their content removed and their account suspended or terminated without notice. Reports of objectionable content are reviewed within 24 hours. Content found to violate these Terms will be removed and the reporting user notified. You may report objectionable content or abusive behaviour through the reporting tools provided in the app. You may also block other users to prevent their content from appearing in your experience.
4. SUBSCRIPTIONS AND PAYMENTS
4.1 Slopestory Pass. We offer an optional subscription service called Slopestory Pass that provides premium features including additional photo storage, AI-powered resort discovery, and trip summaries. Subscription details, pricing, and included features are displayed in the app at the time of purchase.
4.2 Billing. Slopestory Pass subscriptions are billed through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase. By subscribing, you agree to Apple's terms for in-app purchases.
4.3 Auto-Renewal. Your subscription automatically renews unless you cancel it at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price you originally purchased unless we notify you of a price change. You can manage and cancel your subscription at any time through your Apple ID settings or the App Store.
4.4 Free Trials. If we offer a free trial period, the specific duration and terms will be clearly stated at the time of sign-up. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription at the displayed price.
4.5 Price Changes. We may change subscription pricing from time to time. Any price changes will take effect at the start of the next billing period following the date of the price change. Your continued use of the Service after the price change takes effect constitutes your agreement to pay the updated amount.
4.6 Refunds. Subscription refund requests are handled by Apple in accordance with Apple's refund policies. Contact Apple Support for refund inquiries.
5. PHOTO BOOK SERVICE
5.1 Ordering. The Service may offer the ability to order printed photo books created from your uploaded photos. Orders are fulfilled by third-party print and delivery partners.
5.2 Print Quality. Photo books are printed using your original-quality uploaded photos. We store original-resolution versions of your photos specifically for this purpose. Print quality depends on the resolution and quality of photos you upload.
5.3 Pricing and Payment. Photo book pricing, shipping costs, and payment terms will be displayed at the time of ordering. All payments are processed through secure third-party payment processors.
5.4 Returns and Refunds. Returns and refund policies for photo books will be specified at the time of ordering and are subject to the policies of our print fulfillment partners.
6. AI-POWERED FEATURES
6.1 AI Services. The Service includes AI-powered features such as resort discovery recommendations and trip summaries. These features use third-party AI services (currently Anthropic) to process your requests.
6.2 AI Output. AI-generated content (such as resort recommendations and trip summaries) is provided for informational and entertainment purposes only. We do not guarantee the accuracy, completeness, or reliability of AI-generated content.
6.3 Data Processing. When you use AI features, relevant information (such as your preferences or visit details) is sent to our AI service providers for processing. This is described in our Privacy Policy. Our AI service providers do not use your data to train their models.
7. RESORT INFORMATION
7.1 Accuracy. Resort information displayed in the Service (including statistics, season dates, and facilities) is provided for informational purposes only. We make reasonable efforts to keep this information accurate but do not guarantee its completeness or currency. Always check with the resort directly before planning a trip.
7.2 User Submissions. You may submit corrections or additions to resort information. We review submissions before publishing and reserve the right to accept, modify, or reject any submission.
8. INTELLECTUAL PROPERTY
8.1 Our Content. The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Slopestory. The Service is protected by copyright, trademark, and other laws of Australia and international treaties.
8.2 Trademarks. Our name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Slopestory. You must not use such marks without our prior written permission.
8.3 Feedback. If you provide us with any feedback, suggestions, or ideas regarding the Service, you grant us an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to use such feedback in any manner and for any purpose.
9. PROHIBITED USES
You agree not to use the Service:
- In any way that violates any applicable law or regulation
- To impersonate or attempt to impersonate another person or entity
- To engage in any conduct that restricts or inhibits anyone's use of the Service
- To attempt to gain unauthorised access to any portion of the Service
- To use any automated means (bots, scrapers, etc.) to access the Service
- To upload or transmit viruses or malicious code
- To collect or harvest personal information from other users
- To interfere with the proper working of the Service
10. THIRD-PARTY SERVICES
The Service integrates with and relies on third-party services including but not limited to Supabase (data storage and authentication), Cloudflare (content delivery and photo storage), Mapbox (mapping), Anthropic (AI), Sentry (error reporting), PostHog (analytics), Apple (payment processing and app distribution), and Peecho (print fulfillment). Your use of the Service is also subject to the terms and policies of these third-party providers. We are not responsible for the practices or content of third-party services.
11. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from the Service will be accurate or reliable
- Any errors in the Service will be corrected
Resort conditions, weather, and safety are outside our control. The Service is not a substitute for checking current conditions with resorts directly.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SLOPESTORY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorised access, use, or alteration of your transmissions or content
- Loss or corruption of your photos or other User Content
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under the Australian Consumer Law. To the extent that our liability cannot be excluded, our liability is limited to the re-supply of the Service or the cost of re-supply, at our election.
13. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Slopestory and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:
- Your use of and access to the Service
- Your violation of any term of these Terms
- Your violation of any third-party right, including any copyright, property, or privacy right
- Any claim that your User Content caused damage to a third party
14. TERMINATION
14.1 By You. You may stop using the Service and delete your account at any time. If you have an active subscription, you must cancel it separately through your Apple ID settings.
14.2 By Us. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
14.3 Effect. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
15. CHANGES TO TERMS
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect by posting the updated Terms in the app and updating the 'Last updated' date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
16. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
17. SEVERABILITY
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
18. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Slopestory regarding your use of the Service.
19. APPLE APP STORE ADDITIONAL TERMS
The following additional terms apply when you access the Service through the Apple App Store:
19.1 Acknowledgement. These Terms are between you and Slopestory only, and not with Apple Inc. ('Apple'). Slopestory, not Apple, is solely responsible for the Service and its content.
19.2 Scope of Licence. The licence granted to you for the Service is limited to a non-transferable licence to use the Service on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
19.3 Maintenance and Support. Slopestory is solely responsible for providing any maintenance and support services with respect to the Service. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service.
19.4 Warranty. Slopestory is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service.
19.5 Product Claims. Slopestory, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of the Service, including but not limited to: (a) product liability claims; (b) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
19.6 Intellectual Property Claims. In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, Slopestory, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.
19.7 Third-Party Beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
19.8 Legal Compliance. You represent and warrant that: (a) you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a 'terrorist supporting' country; and (b) you are not listed on any US Government list of prohibited or restricted parties.
